UK Toys Safety Regulations

After the UK officially left the EU in January 2020, the original EU Toy Safety Directive (2009/48/EC) was converted into UK domestic law. The regulation was developed in 2011 to replace the EU Toy Safety Directive (2009/48/EC) and will be fully applicable to England, Wales and Scotland from 1 January 2021 (the end of the Brexit transition period).

For toys specially designed for children under 14 years old, Including electronic toys, plush toys, puzzle toys, etc. ( Exempt products : Antique toys, homemade toys without commercial circulation attributes, professional amusement facilities (such as large park equipment).

Regulatory requirements:

1. The toy does not endanger the safety and health of the user or others during normal use;

2. The manufacturer needs to conduct safety assessment and follow the conformity assessment procedures;

3. The UKCA mark needs to be affixed to the product (from January 1, 2021);

4、 Draft a declaration of conformity document;

5. Technical documents need to be kept for at least 10 years;

6. The product should be marked with manufacturer information and instructions for use;

7. Importers need to appoint an authorized representative in the UK.

Regarding chemical safety requirements, the UK made important changes to the regulations in 2022:

1. The control of aniline (textile/leather ≤ 30mg/kg, finger paint ≤10mg/kg) and formaldehyde (different materials have different limits) has been added;

2. Revised aluminum migration limit (e.g., dry/fragile materials from 5625mg/kg to 2250mg/kg);

3. Three new banned allergenic fragrances (Butylphenyl methylpropional, HICC, Atranol) have been added, bringing the total to 58.

Regarding the UKCA mark, it is stated that from January 1, 2021, the UKCA mark will be used instead of the CE marking; If the product has been CE certified by the UK Notified Body before 2021, the CE mark can continue to be used until the end of 2022; The UKCA mark will be fully mandatory from 1 January 2023.

United Kingdom Toys (Safety) Regulations 2011 (S.I. 2011 No.1811) to Child safety is at the core, continue to upgrade the compliance threshold by dynamically updating chemical limits (such as aluminum and formaldehyde), expanding the scope of allergenic fragrance prohibitions, and strengthening the supervision of UKCA marks. Covering the physical and mechanical properties, flammability, chemical properties, electrical properties, hygiene requirements, noise requirements, etc. of toys, the specific requirements are similar to the EU Toy Safety Directive 2009/48/EC, such as limiting the content of toxic and harmful substances, stipulating the flame retardant performance of toys, etc., which need to be focused on:

Chemical compliance : Track new substance limits (e.g. aniline) and standard updates (see the latest list of harmonized standards).

Document integrity : Ensure that the technical documentation includes the EN 71 series test report and the cybersecurity certificate (connected toys).

Identity switching : Full use of the UKCA mark after 2023 to avoid customs clearance blockage.
